Defendant homeowner failed to fix a weak, rotting board on some steps leading up to a highly elevated deck attached to the home. Plaintiff stepped on the board. It gave way and plaintiff fell approximately 15 feet to the ground. Plaintiff was rendered unconscious for several minutes. While unconscious, a poisonous Brown recluse Spider bit him in the arm causing permanent skin damage, nerve damage and partial paralysis in his arm.
Is defendant homeowner liable in money damages in a lawsuit brought by plaintiff for his personal injury? Why or why not?
